Privacy Policy

This policy explains how Infinity Wholesale Mortgages (“we,” “us”) collects, uses, shares and protects your personal information when you visit iwmortgages.com, fill out one of our forms (including Meta lead forms on Facebook and Instagram), message us on WhatsApp, call or text us, or apply for a mortgage loan with us.

Legal entity: Infinity Wholesale Mortgages, LLC, a mortgage broker licensed by the Florida Office of Financial Regulation (license MBR5788) and the Texas Department of Savings and Mortgage Lending, NMLS 2420223.

1. Information we collect

a) Website forms and Meta lead forms (Lead Ads). When you fill out a form, such as “Do you qualify to buy a home in Florida?”, we collect:

  • your full name, phone number and email address (Meta may pre-fill these from your account; you can edit them before submitting);
  • your answers: when you’d like to buy, whether it would be your first home, how you earn your income (for example, W-2 employee, self-employed or investor), whether you already work with a real estate agent, and the area where you want to buy;
  • your consent to be contacted by phone call, text message and WhatsApp, with the date and time you gave it;
  • campaign data Meta sends with the form (form name, campaign, ad set and ad).

These forms do not ask for your Social Security number, credit score, exact income or immigration status.

b) WhatsApp, calls and text messages. Your phone number, profile name, the content of messages and files you send us, call recordings or notes (where allowed by law and with notice to you), and the date and time of each communication.

c) Loan application. If you decide to apply for a loan, we collect the information needed to process it, such as identification, Social Security number or ITIN, income, employment, assets, debts, credit history and property information. We request it only when we need it for your application.

d) Cookies and analytics. Our website and the services embedded in it (for example, Google reviews, YouTube videos and maps) may use cookies and similar technologies to make the site work, remember your preferences and measure site usage. We may use analytics or advertising tools, such as Google Analytics or the Meta Pixel, to measure the results of our ads. You can block or delete cookies in your browser settings and adjust your ad preferences on Facebook, Instagram and Google.

2. How we use your information

  • To contact you and talk with you about your mortgage options in Florida or Texas.
  • To evaluate, process and close your loan application if you decide to apply.
  • To follow up, answer your questions and provide customer service.
  • To send you information about our services, only if you have authorized it. You can opt out at any time.
  • To improve our website, our ads and our service.
  • To comply with the laws and regulations that apply to mortgage brokers and to prevent fraud.

3. Who we share your information with

We do not sell or rent your personal information to anyone. We share it only in these cases:

  • Service providers that work for us and may use it only to provide their services to us: our customer relationship management (CRM) system, phone, text messaging and WhatsApp providers, email, cloud storage, e-signature and website hosting.
  • To process your loan, and only when you have an application in progress: wholesale lenders, credit reporting agencies, title and closing companies, appraisers, insurers and other parties needed for the transaction.
  • When required by law: when required by law, regulation, court order or a regulatory authority, or to protect our rights and prevent fraud.
  • With your permission, in any other case. For example, if you ask us to refer you to a real estate agent.

When you fill out a form on Facebook or Instagram, Meta also processes that information under its own privacy policy. When you message us on WhatsApp, WhatsApp processes your messages under its own policy.

4. Gramm-Leach-Bliley Act (GLBA) notice

As a financial services company, we comply with the federal Gramm-Leach-Bliley Act and its Privacy Rule. If you apply for or obtain a loan through us, we will provide our GLBA privacy notice, which explains what nonpublic personal financial information we collect, how we share it and how we protect it. We do not share your nonpublic personal information with nonaffiliated third parties so they can market their own products to you. We share it only as permitted by law, for example to process your loan.

5. Calls, text messages and WhatsApp (TCPA)

If you give us your consent, for example by checking the box on a form, you agree that Infinity Wholesale Mortgages and Adrian Colin may contact you by phone call, text message and WhatsApp at the number you provided to discuss mortgage options, including through automated dialing systems or prerecorded messages. Your consent is not a condition of purchasing any product or service. Message frequency varies. Message and data rates may apply depending on your plan.

How to opt out: reply STOP to any text or WhatsApp message. For help, reply HELP. You can also ask us to stop calling or messaging you at any time by phone or email (see section 12). We will honor your request within a reasonable time, as required by law. Even if you opt out of marketing messages, we may still contact you about a loan application in progress.

We do not sell or share your phone number or your text messaging consent with third parties for their marketing purposes.

6. How long we keep your information

We keep your information as long as we need it for the purposes described in this policy. We keep application and loan records for as long as federal and state law require. If you don’t move forward with an application, we keep your contact details and answers while we remain in contact with you, or until you ask us to delete them, unless the law requires us to keep them.

7. How we protect your information

We use reasonable administrative, technical and physical safeguards to protect your information, such as limiting access to staff who need it, passwords, encrypted connections and service providers that are required to protect it. No system is completely secure, but we work to protect your information and will notify you when required by law. We will never ask for your Social Security number or bank details through an ad form or by text message unless you have started an application.

8. Use of technology service providers and artificial intelligence

Infinity Wholesale Mortgages (NMLS #2420223) uses trusted technology service providers to help us operate our business, including software that uses artificial intelligence (“AI”). These tools help our team organize and summarize messages and calls, prepare drafts, keep our loan files up to date, and review documents you provide.

  • People make the decisions. AI tools do not approve, deny, or price your loan, and they do not decide whether you qualify. A licensed loan officer or team member reviews AI-assisted work before it is used or sent to you. Final credit decisions are made by the lender.
  • Limited use of your information. We share your information with these providers only so they can perform services for us. Our agreements require them to keep it confidential, protect it, and not use it for any other purpose. We do not allow providers to use your nonpublic personal information to train their general AI models when we can control that setting or term.
  • Security. We protect your information under our written information security program, including access controls and multi-factor authentication.
  • Calls may be recorded or transcribed. We will tell you at the start of a call if it may be recorded or transcribed, including by AI.
  • Talking to a person. You can always ask to speak with a person. If we ever use an automated assistant to communicate with you, we will tell you that you are communicating with AI.

9. Children

Our services are intended for people 18 and older. We do not knowingly collect information from children under 13. If you believe a minor has given us their information, contact us and we will delete it.

10. Florida, Texas and the United States

Infinity Wholesale Mortgages offers mortgage loans only for properties in the States of Florida and Texas. Our website is intended for people in the United States, and your information is processed and stored in the United States.

11. Your rights and choices

At any time, you can ask us to:

  • tell you what information we have about you and give you a copy;
  • correct information that is inaccurate or incomplete;
  • delete your information, except what the law requires us to keep;
  • stop marketing calls, texts, WhatsApp messages or emails;
  • withdraw the consent you gave us to contact you.

To do so, email or call us (see section 12). We may ask for some details to verify your identity before responding. We will not treat you differently for exercising these rights.
